Pracovn\u00ed volno se ozna\u010duje jako <em>\u201ejin\u00e9 d\u016fle\u017eit\u00e9 p\u0159ek\u00e1\u017eky v\u00a0pr\u00e1ci<\/em>\u201c. Pracovn\u00ed volno m\u016f\u017ee b\u00fdt placen\u00e9 \u010di neplacen\u00e9. <strong>V\u00a0p\u0159\u00edpadech stanoven\u00fdch z\u00e1konem mus\u00ed zam\u011bstnavatel pracovn\u00ed volno proplatit. Dle na\u0159\u00edzen\u00ed se <em>\u201epracovn\u00ed volno poskytne na 2 dny na vlastn\u00ed svatbu, z toho 1 den k \u00fa\u010dasti na svatebn\u00edm ob\u0159adu; n\u00e1hrada mzdy nebo platu p\u0159\u00edslu\u0161\u00ed v\u0161ak pouze za 1 den. Pracovn\u00ed volno s n\u00e1hradou mzdy nebo platu se poskytne rodi\u010di na 1 den k \u00fa\u010dasti na svatb\u011b d\u00edt\u011bte a ve stejn\u00e9m rozsahu se poskytne pracovn\u00ed volno bez n\u00e1hrady mzdy nebo platu d\u00edt\u011bti p\u0159i svatb\u011b rodi\u010de.\u201c<\/em><\/p>\n<p>D\u00e1le lze \u010derpat pracovn\u00ed placen\u00e9 volno p\u0159i narozen\u00ed d\u00edt\u011bte, pokud otec veze svou man\u017eelku a nast\u00e1vaj\u00edc\u00ed matku do porodnice, \u00famrt\u00ed, jako doprovod (man\u017eela, druha, rodi\u010d\u016f, d\u00edt\u011bte k\u00a0l\u00e9ka\u0159i). Placen\u00e9 volno na jeden den mohou obdr\u017eet tak\u00e9 d\u00e1rci krve (v ojedin\u011bl\u00fdch p\u0159\u00edpadech lze prodlou\u017eit na 48 a\u017e 96 hodin). <strong>N\u00e1hrada mzdy se po\u010d\u00edt\u00e1 stejn\u011b jako n\u00e1hrada mzdy za dovolenou<\/strong>. Pro mzdu (v soukrom\u00e9 sf\u00e9\u0159e) funguj\u00ed stejn\u00e9 podm\u00ednky jako pro plat (ve ve\u0159ejn\u00e9 sf\u00e9\u0159e).<\/p>\n<p><strong>Pokud jste doma s\u00a0nemocn\u00fdm d\u00edt\u011btem, \u010derp\u00e1te o\u0161et\u0159ovn\u00e9<\/strong>, co\u017e je d\u00e1vka\u00a0nemocensk\u00e9ho poji\u0161t\u011bn\u00ed, nikoli placen\u00e1 p\u0159ek\u00e1\u017eka v\u00a0pr\u00e1ci. Nedostanete tedy stoprocentn\u00ed n\u00e1hradu mzdy, ale pouze n\u00e1hradu mzdy ve v\u00fd\u0161i 60 %.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>N\u00e1hradn\u00ed volno<\/strong><\/p>\n<p>Kdy m\u00e1te n\u00e1rok na n\u00e1hradn\u00ed volno? Dostanete jej za pr\u00e1ci p\u0159es \u010das nebo za ty dny, kdy jste byli v\u00a0pr\u00e1ci, nap\u0159\u00edklad ve st\u00e1tn\u00ed sv\u00e1tek, a m\u011bli jste b\u00fdt doma. Zam\u011bstnavatel m\u016f\u017ee zam\u011bstnanci na\u0159\u00eddit ro\u010dn\u011b maxim\u00e1ln\u011b 150 hodin pr\u00e1ce p\u0159es\u010das za jeden kalend\u00e1\u0159n\u00ed rok. Na dal\u0161\u00edch p\u0159es\u010dasov\u00fdch hodin\u00e1ch se mus\u00ed zam\u011bstnanec se zam\u011bstnavatelem dohodnout. Pr\u00e1ci p\u0159es\u010das zam\u011bstnanci m\u016f\u017ee proplatit, nebo zam\u011bstnanec m\u016f\u017ee \u010derpat n\u00e1hradn\u00ed volno.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Neplacen\u00e9 volno<\/strong><\/p>\n<p>Na neplacen\u00e9 volno m\u00e1te n\u00e1rok dle na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 590\/2006 Sb., kter\u00e9 <strong>specifikuje v\u00fd\u0161e uveden\u00e9 placen\u00e9 p\u0159ek\u00e1\u017eky v\u00a0pr\u00e1ci a tak\u00e9 mo\u017enost \u010derpat neplacen\u00e9 volno, tedy p\u0159ek\u00e1\u017eky v\u00a0pr\u00e1ci bez n\u00e1hrady mzdy<\/strong>. Neplacen\u00e9 volno m\u00e1 zam\u011bstnavatel povinnost ud\u011blit p\u0159i vlastn\u00ed svatb\u011b, kdy zam\u011bstnanec m\u016f\u017ee \u017e\u00e1dat o dva dny volna, jeden den je placen\u00fd, druh\u00fd neplacen\u00fd. Pokud jde zam\u011bstnanec na svatbu rodi\u010de, m\u00e1 n\u00e1rok na den neplacen\u00e9ho volna. Podrobn\u011bji jsme se touto problematikou zab\u00fdvali v\u00fd\u0161e. Neplacen\u00e9 volno lze ud\u011blit tak\u00e9 na dobu porodu man\u017eelky, tedy p\u0159esn\u011bji: <em>\u201e Pracovn\u00ed volno se poskytne na nezbytn\u011b nutnou dobu a)\u00a0s n\u00e1hradou mzdy nebo platu k p\u0159evozu man\u017eelky (dru\u017eky) do zdravotnick\u00e9ho za\u0159\u00edzen\u00ed a zp\u011bt, b)\u00a0bez n\u00e1hrady mzdy nebo platu k \u00fa\u010dasti p\u0159i porodu man\u017eelky (dru\u017eky).\u201c<\/em><\/p>\n<p>D\u00e1le m\u00e1te n\u00e1rok na neplacen\u00e9 volno p\u0159i st\u011bhov\u00e1n\u00ed, pokud doprov\u00e1z\u00edte \u010dlena \u0161ir\u0161\u00ed rodiny k\u00a0l\u00e9ka\u0159i, p\u0159i doprovodu d\u00edt\u011bte do poradny, pokud hled\u00e1te novou pr\u00e1ci (maxim\u00e1ln\u011b p\u016flden t\u00fddn\u011b), a pokud v\u00e1m zam\u011bstnavatel d\u00e1v\u00e1 v\u00fdpov\u011b\u010f, m\u00e1te n\u00e1rok p\u0159i hled\u00e1n\u00ed pr\u00e1ce na volno placen\u00e9.<\/p>\n<p><strong>Zam\u011bstnavatel mus\u00ed d\u00e1le ud\u011blit neplacen\u00e9 volno zam\u011bstnanci, kter\u00fd kon\u00e1 ve ve\u0159ejn\u00e9m nebo obecn\u00e9m z\u00e1jmu.<\/strong> Jedn\u00e1 se nap\u0159\u00edklad o v\u00fdkon funkce poslance, sen\u00e1tora, \u010dlena zastupitelstva (a\u017e dvacet dn\u016f za rok). Dle <a href=\"http:\/\/zakony.centrum.cz\/zakonik-prace\/cast-8-hlava-1-dil-2-paragraf-200\">\u00a7 200 z\u00e1kon\u00edku pr\u00e1ce<\/a>: <em>\u201e<\/em><em>Zam\u011bstnanci od zam\u011bstnavatele p\u0159\u00edslu\u0161\u00ed pracovn\u00ed volno v nezbytn\u011b nutn\u00e9m rozsahu k v\u00fdkonu ve\u0159ejn\u00fdch funkc\u00ed, ob\u010dansk\u00fdch povinnost\u00ed a jin\u00fdch \u00fakon\u016f v obecn\u00e9m z\u00e1jmu, pokud tuto \u010dinnost nelze prov\u00e9st mimo pracovn\u00ed dobu. N\u00e1hrada mzdy nebo platu od zam\u011bstnavatele v t\u011bchto p\u0159\u00edpadech nep\u0159\u00edslu\u0161\u00ed, nen\u00ed-li d\u00e1le v tomto z\u00e1kon\u011b stanoveno jinak, nebo nen\u00ed-li dohodnuto nebo vnit\u0159n\u00edm p\u0159edpisem stanoveno jinak. Zvl\u00e1\u0161tn\u00ed pr\u00e1vn\u00ed p\u0159edpisy upravuj\u00edc\u00ed p\u0159ek\u00e1\u017eky v pr\u00e1ci z d\u016fvodu obecn\u00e9ho z\u00e1jmu t\u00edm nejsou dot\u010deny.\u201c<\/em><\/p>\n<p>Ostatn\u00ed p\u0159\u00edpady \u010di rodinn\u00e9 situace jsou na zv\u00e1\u017een\u00ed a stoj\u00ed na domluv\u011b mezi zam\u011bstnancem a zam\u011bstnavatelem. <strong>Zam\u011bstnavatel nemus\u00ed neplacen\u00e9 volno ud\u011blit.<\/strong> Nen\u00ed to jeho povinnost. Nej\u010dast\u011bji jej poskytuje p\u0159i del\u0161\u00ed nemoci \u010dlena rodiny nebo p\u0159i cestov\u00e1n\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Neplacen\u00e9 volno a povinn\u00e9 odvody<\/strong><\/p>\n<p>P\u0159i neplacen\u00e9m volnu zam\u011bstnanec <strong>nedostane mzdu a ani n\u00e1hradu mzdy, neodv\u00e1d\u00ed dan\u011b z\u00a0p\u0159\u00edjmu a ani nemus\u00edte odv\u00e1d\u011bt soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed.<\/strong> Jestli\u017ee \u010derp\u00e1te neplacen\u00e9 volno dlouhodob\u011b, m\u016f\u017ee to m\u00edt negativn\u00ed vliv na v\u00fd\u0161i starobn\u00edho d\u016fchodu. Pokud nejste st\u00e1tn\u00ed poji\u0161t\u011bnec, mus\u00edte odv\u00e1d\u011bt ka\u017ed\u00fd m\u011bs\u00edc minim\u00e1ln\u00ed platbu za zdravotn\u00ed poji\u0161t\u011bn\u00ed, kter\u00e1 \u010din\u00ed 13,5 % z\u00a0minim\u00e1ln\u00ed mzdy (v roce 2021 je platba stanovena na 2052 K\u010d m\u011bs\u00ed\u010dn\u011b). Jestli\u017ee budete \u010derpat neplacen\u00e9 volno pouze \u010d\u00e1st m\u011bs\u00edce a z\u00e1rove\u0148 bude minim\u00e1ln\u00ed vym\u011b\u0159ovac\u00ed z\u00e1klad ve v\u00fd\u0161i minim\u00e1ln\u00ed mzdy, odvede se z\u00a0tohoto z\u00e1kladu z\u00e1konem stanoven\u00e9 zdravotn\u00ed poji\u0161t\u011bn\u00ed. Bude-li vym\u011b\u0159ovac\u00ed z\u00e1klad men\u0161\u00ed, odvede se zdravotn\u00ed poji\u0161t\u011bn\u00ed z\u00a0t\u00e9to mzdy a z\u00e1rove\u0148 je pot\u0159eba uhradit doplatek za zdravotn\u00ed poji\u0161t\u011bn\u00ed do z\u00e1konem stanoven\u00e9 v\u00fd\u0161e.<\/p>\n<p>Nezapome\u0148te, \u017ee p\u0159i \u010derp\u00e1n\u00ed neplacen\u00e9ho volna nem\u00e1te n\u00e1rok na d\u00e1vky z\u00a0nemocensk\u00e9ho poji\u0161t\u011bn\u00ed a ani na n\u00e1hradu mzdy.<\/p>\n<p>Pokud pot\u0159ebujete podrobn\u011bj\u0161\u00ed informace o v\u00fd\u0161i odvod\u016f, informujte se na \u00fa\u010detn\u00edm odd\u011blen\u00ed ve firm\u011b, ve kter\u00e9 pracujete a kde \u010derp\u00e1te neplacen\u00e9 volno.
