Sestavili jsme pro v\u00e1s p\u0159ehledn\u00e9 rozd\u00edly mezi dohodou o proveden\u00ed pr\u00e1ce (DPP), dohodou o pracovn\u00ed \u010dinnosti (DP\u010c) a smlouvou na hlavn\u00ed pracovn\u00ed pom\u011br (HPP).<\/strong><\/p>\n<p><!--more--><\/p>\n<h2>Dohoda o proveden\u00ed pr\u00e1ce<\/h2>\n<p>Dohoda o proveden\u00ed pr\u00e1ce je ur\u010dena pro <strong>p\u0159\u00edle\u017eitostn\u00fd p\u0159iv\u00fdd\u011blek v\u00a0rozsahu 300 hodin ro\u010dn\u011b u jednoho zam\u011bstnavatele. <\/strong>U jednoho zam\u011bstnavatele m\u016f\u017eete uzav\u0159\u00edt v\u00edce dohod, kter\u00e9 nemaj\u00ed soub\u011bh, ale mus\u00ed se v\u00a0sou\u010dinu vej\u00edt do\u00a0rozsahu 300 hodin ro\u010dn\u011b. Jestli\u017ee budete dost\u00e1vat <strong>v\u00fdplatu do 10\u00a0000 K\u010d m\u011bs\u00ed\u010dn\u011b, nemus\u00edte z\u00a0dohody o proveden\u00ed pr\u00e1ce odv\u00e1d\u011bt soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/strong> <strong>Zaplat\u00edte pouze sr\u00e1\u017ekovou da\u0148 ve v\u00fd\u0161i 15 %.<\/strong> Dohoda mus\u00ed b\u00fdt uzav\u0159ena p\u00edsemn\u011b. DPP b\u00fdv\u00e1 prim\u00e1rn\u011b ur\u010dena pro p\u0159iv\u00fdd\u011blky, ale pokud nem\u00e1te \u017e\u00e1dn\u00e9 zam\u011bstn\u00e1n\u00ed a jste nap\u0159\u00edklad na rodi\u010dovsk\u00e9 dovolen\u00e9, m\u016f\u017eete u zam\u011bstnavatele podepsat prohl\u00e1\u0161en\u00ed poplatn\u00edka o dani z\u00a0p\u0159\u00edjmu a uplatnit si slevu na dani. Pokud prohl\u00e1\u0161en\u00ed v\u00a0dan\u00e9m roce nepodep\u00ed\u0161ete, m\u016f\u017eete uplatnit vr\u00e1cen\u00ed sr\u00e1\u017ekov\u00e9 dan\u011b v\u00a0da\u0148ov\u00e9m p\u0159izn\u00e1n\u00ed. Jak je to s\u00a0ukon\u010den\u00edm spolupr\u00e1ce? Firma s\u00a0v\u00e1mi m\u016f\u017ee ukon\u010dit spolupr\u00e1ci okam\u017eit\u011b, stejn\u011b tak vy m\u016f\u017eete skon\u010dit ihned.<\/p>\n<h2>Dohoda o pracovn\u00ed \u010dinnosti<\/h2>\n<p>Dohoda se uzav\u00edr\u00e1 zpravidla na rok, ale m\u016f\u017eete ji podepsat i na krat\u0161\u00ed dobu. Pokud pracujete na DP\u010c, m\u016f\u017eete vykon\u00e1vat <strong>rozsah pracovn\u00ed \u010dinnosti maxim\u00e1ln\u011b do 20 hodin t\u00fddn\u011b<\/strong>. U jednoho zam\u011bstnavatele m\u016f\u017eete m\u00edt dle \u00a7 75\u00a0<u><a href=\"http:\/\/www.pracepropravniky.cz\/zakony\/zakonik-prace-uplne-zneni\">z\u00e1kon\u00edku pr\u00e1ce\u00a0<\/a><\/u>uzav\u0159enou <strong>pouze jednu dohodu<\/strong>. Z\u00a0dohody zam\u011bstnavatel strh\u00e1v\u00e1 ka\u017ed\u00fd m\u011bs\u00edc <strong>odvody na soci\u00e1ln\u00ed a zdravotn\u00ed<\/strong> poji\u0161t\u011bn\u00ed, a to i v\u00a0p\u0159\u00edpad\u011b, \u017ee si m\u011bs\u00ed\u010dn\u011b vyd\u011bl\u00e1te do 10\u00a0000 K\u010d. Dohoda o pracovn\u00ed \u010dinnosti je <strong>vhodn\u00e1 pro pravideln\u00fd p\u0159iv\u00fdd\u011blek k\u00a0hlavn\u00edmu pracovn\u00edmu \u00favazku<\/strong>, hod\u00ed se pro rodi\u010de na rodi\u010dovsk\u00e9 dovolen\u00e9. Jestli\u017ee nem\u00e1te \u017e\u00e1dn\u00fd jin\u00fd p\u0159\u00edjem a nejste evidov\u00e1ni na \u00fa\u0159adu pr\u00e1ce, mus\u00edte zaplatit minim\u00e1ln\u00ed odvody na zdravotn\u00ed poji\u0161t\u011bn\u00ed. Minim\u00e1ln\u00ed odvody se vztahuj\u00ed na p\u0159\u00edjem od 3 000 K\u010d do 13 350 K\u010d m\u011bs\u00ed\u010dn\u011b. M\u011bs\u00ed\u010dn\u011b mus\u00edte na zdravotn\u00ed poji\u0161t\u011bn\u00ed zaplatit 1803 K\u010d. Pokud m\u00e1te DP\u010c jako p\u0159iv\u00fdd\u011blek, plat\u00edte minim\u00e1ln\u00ed odvody na zdravotn\u00ed poji\u0161t\u011bn\u00ed ze sv\u00e9 hlavn\u00ed \u010dinnosti a v\u00e1\u0161 p\u0159\u00edjem z\u00a0dohody je ni\u017e\u0161\u00ed ne\u017e 13\u00a0350 K\u010d, nemus\u00edte odv\u00e1d\u011bt minim\u00e1ln\u00ed \u010d\u00e1stku 1803 K\u010d, ale zaplat\u00edte pouze odpov\u00eddaj\u00edc\u00ed procento. <strong>Jestli\u017ee si na DP\u010c vyd\u011bl\u00e1te m\u00e9n\u011b ne\u017e 3 000 K\u010d, nemus\u00edte platit odvody na soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed <\/strong>(p\u0159\u00edklady dle \u010cSSZ najdete v\u00a0<a href=\"https:\/\/www.cssz.cz\/NR\/rdonlyres\/5F467317-15E9-4239-A002-99CAADD4F703\/25353\/NP_2_2019_10_13.pdf\">\u010dl\u00e1nku<\/a>). A jak je to s\u00a0dan\u011bmi? Dan\u011b plat\u00edte stejn\u011b jako u smlouvy na hlavn\u00ed pracovn\u00ed pom\u011br. M\u016f\u017eete podepsat r\u016f\u017eov\u00e9 prohl\u00e1\u0161en\u00ed, nebo m\u016f\u017eete uplatnit slevu na poplatn\u00edka na dani z\u00a0p\u0159\u00edjmu v\u00a0da\u0148ov\u00e9m p\u0159izn\u00e1n\u00ed. V\u00fdpov\u011bdn\u00ed doba je u dohody o pracovn\u00ed \u010dinnosti dva t\u00fddny jak ze strany zam\u011bstnavatele, tak ze strany zam\u011bstnance.<\/p>\n<h2>Smlouva na hlavn\u00ed pracovn\u00ed pom\u011br<\/h2>\n<p>Smlouva na hlavn\u00ed pracovn\u00ed pom\u011br se uzav\u00edr\u00e1 na 40 hodin t\u00fddn\u011b. U vybran\u00fdch profes\u00ed m\u016f\u017ee b\u00fdt po\u010det hodin sn\u00ed\u017een, a to i v p\u0159\u00edpad\u011b pln\u00e9ho \u00favazku. Ve\u0161ker\u00e9 n\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se hlavn\u00edho pracovn\u00edho pom\u011bru upravuje Z\u00e1kon\u00edk pr\u00e1ce v\u00a0\u010d\u00e1sti druh\u00e9,\u00a0hlav\u011b II.<u> <a href=\"https:\/\/business.center.cz\/business\/pravo\/zakony\/zakonik-prace\/cast2h2.aspx\">Pracovn\u00ed pom\u011br<\/a><\/u>. Pracovn\u00ed smlouva mus\u00ed b\u00fdt uzav\u0159ena p\u00edsemn\u011b. Z\u00e1kon ukl\u00e1d\u00e1, \u017ee zku\u0161ebn\u00ed doma, tedy doba, kdy zam\u011bstnanec m\u016f\u017ee podat okam\u017eitou v\u00fdpov\u011b\u010f, nebo s\u00a0n\u00edm zam\u011bstnavatel m\u016f\u017ee na hodinu p\u0159eru\u0161it pracovn\u00ed pom\u011br, je stanovena maxim\u00e1ln\u011b na t\u0159i m\u011bs\u00edce u klasick\u00fdch pracovn\u00edch pozic a na \u0161est m\u011bs\u00edc\u016f u pozic pro vedouc\u00ed zam\u011bstnance. <strong>Od ledna roku 2019 se zv\u00fd\u0161ila minim\u00e1ln\u00ed mzda na 13\u00a0350 K\u010d, a tedy pracovn\u00ed smlouva na pln\u00fd \u00favazek nesm\u00ed b\u00fdt sjedn\u00e1na na ni\u017e\u0161\u00ed v\u00fdplatu.<\/strong> Ze mzdy se odv\u00e1d\u00ed minim\u00e1ln\u00ed z\u00e1lohy na soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed a tak\u00e9 da\u0148. Pokud nechcete, nebo nem\u016f\u017eete, pracovat na pln\u00fd \u00favazek, m\u016f\u017eete zam\u011bstnavatele po\u017e\u00e1dat o uzav\u0159en\u00ed pracovn\u00ed smlouvy na zkr\u00e1cen\u00fd \u00favazek. V\u00fdpov\u011bdn\u00ed doba je uveden\u00e1 ve smlouv\u011b, av\u0161ak nejm\u00e9n\u011b \u010din\u00ed dva m\u011bs\u00edce. N\u011bkter\u00e9 firmy sjedn\u00e1vaj\u00ed t\u0159\u00edm\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed dobu.<\/p>\n<h2>Kde najdete vzory pracovn\u00edch smluv?<\/h2>\n<p>Pracovn\u00ed smlouvu obdr\u017e\u00edte p\u0159i n\u00e1stupu do zam\u011bstn\u00e1n\u00ed. Pokud m\u00e1te men\u0161\u00ed firmu a budete zam\u011bstn\u00e1vat sv\u00e9ho prvn\u00edho pracovn\u00edka, najdete vzory pracovn\u00edch smluv ke sta\u017een\u00ed na internetu, nap\u0159\u00edklad na webu <a href=\"https:\/\/www.profesia.cz\/kariera-v-kostce\/vzory-dokumentu\/vzor-pracovni-smlouvy\/\">Profesia.cz<\/a>. Budete-li pot\u0159ebovat, m\u016f\u017eete vyplnit pracovn\u00ed smlouvu tak\u00e9 <a href=\"https:\/\/www.legito.cz\/pracovni-smlouva?\">online<\/a>.<\/p>\n<h2>Stru\u010dn\u00fd p\u0159ehled: Kdy uzav\u0159\u00edt jakou smlouvu<\/h2>\n<p><strong>DPP:<\/strong> Dohoda o proveden\u00ed pr\u00e1ce se uzav\u00edr\u00e1 zpravidla p\u0159i jednor\u00e1zov\u00e9 \u010dinnosti, kter\u00e1 trv\u00e1 do 300 hodin ro\u010dn\u011b. Pokud je v\u00fdplata do 10\u00a0000 K\u010d, neplat\u00edte soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed a z\u00a0v\u00fdd\u011blku odvedete pouze sr\u00e1\u017ekovou da\u0148 ve v\u00fd\u0161i 15 %.<\/p>\n<p><strong>DP\u010c:<\/strong> Dohoda o proveden\u00ed pr\u00e1ce se uzav\u00edr\u00e1 na pravidelnou vedlej\u0161\u00ed \u010dinnost v\u00a0rozsahu do 20 hodin t\u00fddn\u011b. Do 3 000 K\u010d m\u011bs\u00ed\u010dn\u011b neplat\u00edte soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed. Nad tuto sumu soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed odv\u00e9st mus\u00edte. Dan\u011b ve v\u00fd\u0161i 15 % plat\u00edte v\u017edy.<\/p>\n<p><strong>HPP:<\/strong> Smlouvu na hlavn\u00ed pracovn\u00ed pom\u011br, respektive na pln\u00fd \u010di zkr\u00e1cen\u00fd \u00favazek, uzav\u00edr\u00e1te u zam\u011bstnavatele, u kter\u00e9ho budete denn\u011b doch\u00e1zet do zam\u011bstn\u00e1n\u00ed.
